Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all incomes made (INFO # 3) at the rate accepted by the employer and employment worker.

– Pay of a minimum of minimum wage (INFO # 1), the appropriate Colorado or regional minimum wage, and all earned overtime earnings without impermissible deductions from their incomes;.

– Pay of all made earnings without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements much of Colorado’s wage and hour and other types of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and employment Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please check out the Division’s Labor Statutes and Labor Rules web pages for current and prior variations of crucial Colorado labor statutes and rules.

Published Guidance: The Division’s primary types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notices, viewpoints, and descriptions on numerous labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor employment Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you salaries, you can send your company a written demand for payment of earnings by mail, e-mail, text message, or other electronic means. A written demand might be sent out to the employer at the exact same time a Labor Standards Complaint Form for unsettled wages is filed with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements web page.

Responses in Investigations: Once a complete Labor Standards Complaint Form is received and evaluated, a letter discussing the nature of the complaint and the quantities declared to be owed is sent out to the company. Investigations Launched by the Division (” Direct Investigations”): The Division might conduct employer-wide direct investigations of possible offenses of Colorado wage and hour law. If you would like to submit an idea, please email the Division at cd**********@st***.us. If you would like to submit an individual claim for unpaid earnings, you need to fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements webpage. To appeal a direct examination citation or several Notices of Assessment, a supposed company may send a Direct Investigation Appeal Form.
